DEMOCRATS AND Republicans in Congress can’t seem to agree on the time of day. But that’s not stopping the executive branch when it comes to cranking out red tape. When it comes to federal regulations, the Obama administration is setting productivity records. According to an April 16 report in the Wall Street Journal, President Obama and his busy bees in the executive hive have been churning out new regs like there’s no tomorrow. It cited a study from the Competitive Enterprise Institute, which said Washington set a new record in 2013, issuing 3,659 “final” rules and 2,594 proposed rules that consumed 26,417 pages in the Federal Register. That’s the place where all the regs get published. A “final” rule is one that must be obeyed. A proposed rule is one that’s awaiting the president’s blessing. The CEI study said the entire Federal Register finished last year with 79,311 pages — the fourth highest total in U.S. history. That’s short of the all-time record of 81,405 pages, which Mr. Obama set in 2010. The also president holds the dubious honor of knowing that four of the five highest Federal Register page counts occurred while he was in the Oval Office. (The other occurred in 2008 under the watch of then-President George W. Bush. According to the Journal, the CEI’s Wayne Crews sifts through all these rules each year. Mr. Crews estimates that the overall cost of regulatory compliance and its economic impact is about $1.9 trillion annually. That’s roughly equivalent to the annual GDP of Canada, Australia or Italy. Some regulations, like those that involve food safety or keep people from being injured on the job, are in the public’s interest. But others seem created for the sake of a bigger bureaucracy. All these rules come at a cost. Typically, this expense is passed along to consumers through higher prices for goods and services and to taxpayers through higher taxes. Mr. Crews estimates that U.S. households “pay” a hidden tax of 23 percent of their incomes for regulations ($14,874 annually, out of the average income of $65,596). That’s a big bite. It’s probably not a coincidence that the explosion in red tape has accompanied sluggish job growth during the Obama years.
